Birmingham man killed in massive downtown shootout lost son to fatal stabbing in 2018

A man gunned down in a massive shootout at a downtown Birmingham intersection lost his son to violence in the city six years ago.

The Jefferson County Coroner’s Office on Friday identified the slain man as Dietrich Lamont Boone. He was 45 and lived in Birmingham.

His son, Dietrich Lamont Boone Jr., was fatally stabbed in 2018 during a dispute over a woman. The suspect in that case was acquitted.

Boone Sr. was killed in a hail of gunfire about 2:15 p.m. Thursday at 25th Street and Seventh Avenue North. That intersection is in the middle of an area including Park Place Apartments, Marconi Park, and the Jones Valley Teaching Farm.

North Precinct officers responded to a call of a person shot. When they arrived, they found a grey Chrysler 300 that had crashed into a tree and a utility pole.

Boone Sr. was located about 15 yards away in a grassy are outside of an apartment building. He was rushed to UAB Hospital where he was pronounced dead at 2:36 p.m.

Officer Truman Fitzgerald said investigators believe a shootout happened at the intersection. The victim, he said, was targeted.

Crime scene investigators placed more than 50 evidence marks along Seventh Avenue North. Evidence markers don’t necessarily indicate just one shell casing – a marker can be used to mark multiple shell casings in one spot.

“We have at least 50 shell casings near where kids play, families gather all the time,’’ Fitzgerald said. “Anytime you have this many rounds being fired, we are extremely lucky no one else was hit.”

A woman who posted a Facebook Live video of the aftermath reported seeing at least one of the shooters - wearing a ski mask - hanging out a window firing the gun. It appears the victim was able to return fire before he collapsed.

A gun was found near the victim.

Boone Sr. had posted a Facebook story shortly before the shooting, showing him in that area. A gun was seen in his video.

Fitzgerald said police almost immediately began following at least one lead.

“How we have our lead is pure police work,’’ Fitzgerald said. “We have officers that know their beats, and the officer some of the parties involved, including the victim.”

Boone Jr., 20, was killed Feb. 9, 2018.

The man who killed him was a former Birmingham police recruit who had resigned from his position at the Birmingham Police Academy prior to being terminated after allegations of conduct violations were sustained against him. He was never a certified police officer with the department, and during the time of the alleged shooting was not employed with the department.

Police initially believed Boone Jr. was shot to death, but an autopsy later determined that while a shot had been fired at Boone, he was killed in a stabbing.

The shooting happened about 1 p.m. that Friday in the 8400 block of Ninth Avenue South. Birmingham police said Gaines went to Boone’s home and confronted the victim.

About an hour after the shooting, Gaines surrendered to police. It appears, investigators said, the killing stemmed from a domestic dispute. The two had a female acquaintance in common.

A jury found the suspect killed Boone Jr. in self-defense.

Detectives need anyone with information in Boone Sr.’s death to come forward.
