Defendant wants to withdraw plea; attorney withdraws

The case of a man accused of stealing tens of thousands of dollars in frozen fish from his Warren employer appeared to be resolved a year ago but remains in question after the defendant has received a new attorney.

Erwin Wlilson, 31, of Chesterfield Township, in July 2023 pleaded no contest as charged in Macomb County Circuit Court to embezzlement between $50,000 and $100,000 related to the accusation he loaded a Cadillac Escalade with hundreds of frozen fish from a Lipari Foods warehouse and drove away in May 2023. The charge is punishable by up to 15 years in prison.

As part of the plea, Wilson agreed to repay Lipari $67,500, and his habitual status would be dismissed.

But since last September, he has been seeking to withdraw his plea, and in May, his attorney, Steven Vernier, withdrew from the case. The new attorney is Anthony Jacobs.

Also in May, Judge Matthew Sabaugh denied Wilson’s request to be admitted to Drug Court.

A New Haven man posted $2,000 to satisfy a $20,000 bond for Wilson to be released while the case was pending, according to court records. But he was placed on a “hold” by the Michigan Department of Corrections because he was on parole at the time for one of two 2017 first-degree home-invasion convictions for 2016 incidents in Chesterfield Township, according to court records. He was arrested after he came face to face with a married couple in their Maple Court home and fled, but police connected him to two other incidents in the township. He also pleaded no contest to an attempted home invasion.

He was sentenced by Macomb Circuit Judge Edward Servitto to nearly six years up to 20 years in prison, and had received credit for nearly 10 months in jail.

The bond funds were later returned to the man who posted them, records say.

Wilson is scheduled to be sentenced July 24.
