3 charged in Eastpointe drive-by shooting, St. Clair Co. standoff

Three people have been charged in connection with a drive-by shooting in Eastpointe and a stand-off in St. Clair County, police said.

Tyler Fistler, 21, Derek Morris, 51, and Jaraldine Morris, 81, were arraigned Thursday on charges in connection with the two incidents in 38th District Court in Eastpointe, officials and court records said.

Fistler was charged with multiple crimes, including two counts of assault with intent to murder; using a computer to commit a crime; tampering with evidence; four weapons violations; and malicious use of a telecommunications device, officials said.

A magistrate set bond at $1 million and scheduled his next court appearance for July 9.

If convicted, he faces up to life in prison for each of the assault with intent to murder charges, 20 years to life for using a computer to commit a crime and at least 10 years for the tampering with evidence charge. Malicious use of a telecommunications device is a six-month misdemeanor.

Fistler waived his right to an attorney, according to court records.

Derek Morris was charged with two counts of assault with intent to murder; being an accessory after the fact to a felony; lying to a peace officer; using a computer-internet-communication with another to commit a crime; and malicious use of telecommunication services, police said.

A magistrate set his bond at $500,000 and scheduled Morris' next court appearance for July 9.

If convicted, he faces up to life in prison for the assault with intent to murder charge, up to five years for the accessory charge, up to four years for the lying to a police officer charge and one year for the use of the internet to commit a crime charge.

Court records did not list an attorney for Morris.

Jaraldine Morris was charged with tampering with evidence, being an accessory after the fact to a felony, and lying to a peace officer.

A magistrate set her bond at $50,000 and scheduled her next court appearance for July 9.

If convicted, she faces up to 10 years for the tampering with evidence charge, up to five years for being an accessory and up to four years for lying to a peace officer.

Court records did not list an attorney for Morris.

Police said the two men are suspects in a drive-by shooting that happened at about 1:10 a.m. Tuesday at a home in the 16000 block of Forest Street near Stephens and Kelly roads in Eastpointe.

According to a preliminary investigation, the incident's victim was in an ongoing dispute with his ex-girlfriend's new boyfriend, a St. Clair County man. Officers arrived at the residence and determined the new boyfriend allegedly fired numerous shots into the victim's home before fleeing.

Police said Wednesday that multiple people, including six children, were home at the time. However, no one was injured by the shots.

Eastpointe investigators believed the suspects were heading to an apartment in Casco Township and notified St. Clair County Sheriff's deputies.

Eastpointe officers, St. Clair County deputies, Macomb County Sheriff's deputies, Port Huron police as well as Richmond officers responded and converged at the apartment.

As they approached the apartment, a man with a rifle, a second man and a woman all exited the home, authorities said. They reported the two men quickly retreated into the apartment but the woman remained outside and spoke with police.

St. Clair County Sheriff's deputies said negotiations with the two men and other tactics initially failed to get them to leave the apartment.

Eastpointe officials said its detectives obtained a search warrant for the apartment. St. Clair County and Port Huron special tactics teams executed the warrant and arrested the two suspects.

Police also recovered multiple pieces of evidence from the scene, according to investigators.

On Friday, Eastpointe police said they recovered additional evidence that the homeowner hid for the suspects. Officers arrested the homeowner.
