In a significant legal development, the Court of Appeal has overturned a previous decision that had dismissed Martin Amaewhule and 24 other members from their positions in the Rivers State House of Assembly. This ruling reinstates their status as assembly members, reversing the earlier judgement which had removed them from office. The appeal court’ s decision vacates the order of Justice C. N. Wali of the Rivers State High Court. In its ruling, the Court of Appeal emphasized that only the Federal High Court has the jurisdiction to determine cases concerning the tenures and vacancies of the House of Assembly, Governors, and the President. State High Courts, the court clarified, do not hold such authority. According to the Appeal Court, there was no dispute over the speakership of Rt. Hon. Martins Amaewule. ” From the foregoing, it is the view of the learned judges that there was no contention on the speakership of Rt. Hon. Martins Amaewule from the records, and therefore, he remains the speaker, ” the appellate court ruled. This clarification reinstates Amaewule to his position, affirming his leadership role in the assembly. This ruling brings a significant resolution to the legal battle surrounding the tenure of the assembly members and highlights the clear jurisdictional boundaries between federal and state courts in Nigeria.
