A Davenport man has been sentenced to 10 years and six months in federal prison after pleading guilty to charges of selling marijuana and possessing a firearm in furtherance of trafficking drugs.

The case against Horne began Feb. 2, 2023, when Davenport Police arrested Horne on charges of possession with the intent to distribute marijuana, failure to affix an Iowa drug tax stamp, felon in possession of a firearm and unauthorized possession of offensive weapons.

The Davenport Police Department’s Narcotics Unit had served a search warrant at Horne’s residence in the 2600 block of North Harrison Street.

From Horne’s residence, officers seized 514.15 grams, or 1.13 pounds, of marijuana, 10 packages of marijuana edibles, packaging materials, a digital scale containing marijuana residue and $1,656 in cash.

Officers also seized a loaded .45-caliber Glock semi-automatic pistol with an extended magazine. The pistol also was equipped with what is known as a Glock full auto switch that makes the pistol fully automatic, such as a machine gun.

Having such a switch on a gun is illegal under federal law.

At the time he was arrested Horne was serving a sentence of two years on probation in Scott County after being convicted of second-degree theft on Dec. 31, 2020.

Horne violated his probation in May of 2022 after he was arrested by Rock Island County authorities on one count of felon in possession of a firearm, a Class 3 felony under Illinois law that carries a prison sentence of 2-5 years, and one count of possession of a stolen firearm, a Class 2 felony that carries a prison sentence of 3-7 years. That case is pending in Rock Island County Circuit Court.

Federal authorities took over the marijuana and weapons case from Davenport after a federal grand jury indicted Horne on July 6, 2023, on charges of possession with the intent to deliver a controlled substance-marijuana, possession of a firearm in furtherance of a drug crime, felon in possession of a firearm and illegal possession of a machine gun.

Federal authorities arrested Horne on July 14, 2023.

During a change of plea hearing held Jan. 16, Horne pleaded guilty to the drug charge and the charge of possession of a firearm in furtherance of a drug crime. The other two charges were dismissed in a plea agreement.

Ebinger sentenced Horne to six months on the marijuana trafficking charge and a consecutive term of 120 months, or 10 years, on the weapons charge.

Horne also was sentenced to serve five years on supervised release after he completes his prison sentence. There is no parole in the federal prison system. Horne will receive credit for the time he has served in custody awaiting trial and sentencing on the charges.
