Drug case will proceed against man police arrested after fatal Export shooting

A man who police say was involved in a fatal shooting in Export last month waived his right Tuesday morning to a preliminary hearing for drug offenses.

Matthew A. Miller, 32, was taken into police custody June 18 after a shooting that resulted in the death of Daniel T. Chicka Jr., 65, of Avonmore. State police said the shooting, which occurred in the 5800 block of Madison Avenue, stemmed from a monthslong parking dispute between Miller and Chicka.

No charges have been filed in relation to the shooting. Police uncovered 20 marijuana plants and drug paraphernalia in Miller’s basement while investigating the shooting, according to court documents.

Miller was charged with drug possession with intent to manufacture or deliver and possession of drug paraphernalia. He waived his right to a preliminary hearing under District Judge Judi Petrush Tuesday.

About 20 people filled the waiting room at Petrush’s office in support of Chicka, known by close friends and family as “Slim.” They donned t-shirts with a photo of Chicka surrounded by the words “Justice for Slim” and “Rest easy Bro, we got this.”

Miller was denied bail in June at his arraignment by Petrush, who noted in court records Miller has ties to Arizona and does not have a stable residence.
