Kanu Appeals Court Decision On Jurisdiction In Nyako’s Court...CONTINUE READING

Mazi Nnamdi Kanu, leader of the Indigenous People of Biafra (IPOB), has lodged an appeal against the Federal High Court’s ruling on June 19, presided over by Justice Binta Nyako in Abuja. The ruling dismissed Kanu’s objection to the court’s jurisdiction over his trial. Kanu, represented by his Special Counsel Chief Aloy Ejimakor, filed the appeal at the Court of Appeal in Abuja on Tuesday.

Ejimakor disclosed this in a statement released Tuesday night, stating, “Earlier today, I filed a Notice of Appeal with the Court of Appeal in Abuja against the June 19, 2024 ruling of Justice Binta Murtala-Nyako, rejecting Mazi Nnamdi Kanu’s objection to the jurisdiction of the Federal High Court to subject him to trial. The appeal is based on seven grounds primarily focused on constitutional provisions, the Terrorism Prevention and Prohibition Act 2022, and other relevant statutes.”

The appeal lists the Federal Government of Nigeria as the sole respondent, represented by Asiwaju Adegboyega Awomolo, SAN.

Kanu has been detained at the Department of State Services (DSS) headquarters in Abuja since his extradition from Kenya in June 2021.

The notice of appeal further states, “The Appellant, being dissatisfied with the ruling of the Federal High Court, Abuja Division delivered on June 19, 2024, intends to appeal to the Court of Appeal, Abuja based on the grounds outlined below and seeks specific reliefs.”

It continues, “Ground one: Error in law – The trial court erred in law and caused a miscarriage of justice by stating that the option for the Appellant, if dissatisfied with the charges, is appeal, contrary to established legal principles.”

The grounds of appeal include detailed legal arguments challenging the jurisdiction of the court and the handling of specific charges against Kanu.

The appeal underscores Kanu’s persistence in challenging the legal basis for his trial amidst ongoing legal battles.
