A Tale of Two Restaurants Following storm damage, the original Lotus of Siam on Sahara Avenue closed its doors in 2017. Daughter Penny Chutima was granted permission to open a new branch on East Flamingo Road under strict conditions set by TChutima Inc., the trademark owner. Surprisingly, Saipin and Suchay Chutima do not have ownership of the Flamingo restaurant but rather license their trademark to Penny's entity. Expansion Plans Thwarted In a surprising turn of events, Penny Chutima teamed up with hospitality veteran Lou Abin to establish a Lotus of Siam outpost at Red Rock Resort in April 2021. However, a trademark dispute has put a halt to their expansion dreams. Legal Wrangling While much of the complaint remains under wraps, it is clear that the crux of the matter lies in differing interpretations of the Trademark Agreement. TChutima insists on approval rights for any use of the Lotus of Siam trademark by Bua Group. The lawsuit seeks to enforce this provision and resolve the ongoing dispute.
