Legal Decision Prevents Kano APC Ward Executives From Sacking Ganduje...CONTINUE READING

A Federal High Court in Kano, under the guidance of Justice A. M. Liman, has issued a restraining order preventing the executive members of the All Progressives Congress (APC) at Ganduje Ward from suspending the party’s national chairman, Abdullahi Ganduje. This injunction stands until the court hears and resolves a lawsuit filed by Ganduje concerning the protection of his fundamental rights.

Ganduje, the former governor of Kano State, sought legal recourse through his counsel, Barrister Hadiza Nasir Ahmed, to safeguard his rights to fair hearing and freedom of association as enshrined in Section 46 of the Constitution of the Federal Republic of Nigeria, 1999 as amended, and the Enforcement and Procedure Rules, 2009.

The court’s decision followed the consideration of an ex parte motion submitted by Ganduje’s legal team. Justice Liman additionally instructed all involved parties to maintain the status quo preceding the purported emergency meeting where the suspension was discussed. Furthermore, any actions pertaining to the issue are to be halted until the motion on notice receives a hearing and resolution.

The judge’s order explicitly restrains all respondents, their representatives, agents, or affiliates from implementing or enforcing the purported decision made during the alleged Emergency Meeting of the APC Ganduje Ward on April 20, 2024, until the substantive application for the enforcement of the applicant’s fundamental rights is heard and determined.

Respondents named in the lawsuit include Basiru Nuhu Isah, the Nigeria Police Force, the Commissioner of Police, Kano Command, the Inspector General of Police, and the Department of State Service.
