Court fixes July 22 for definite hearing on Delta divorce suit

Guardian Nigeria 2024/7/26

The Asaba Customary District court, yesterday, fixed July 22, for definite hearing in a divorce suit instituted by one Mrs Uche MaryRose Ezenyili for the dissolution of her marriage.

President of the court, V. Rapu, who adjourned the matter, urged the parties to be in court on July 22, without fail. The adjournment was followed a written application earlier submitted to the court by counsel to the respondent, Ariomaghwa Medjor.

In the application, Medjor informed the court of his absence due to his involvement in another case at the Federal Court sitting in Asaba, while the respondent and husband to the plaintiff, Mr Obi Kelvin Ezenyili, was also absent from court.

Counsel to the plaintiff, Humphrey Ororho, however, opposed the request, describing it as a deliberate ploy by the defence to unnecessarily delay hearing of the case.

The plaintiff had instituted the suit, praying the court to dissolve the marriage over irreconcilable differences and lack of love.
However, the respondent, in a counter petition, described the claim as false, adding that he still loves his wife.

The suit had suffered several setbacks as it was initially instituted at the Ubulu-Okiti customary court, then transfered to Oko customary court before it was finally taken to Asaba Customary District Court.

Speaking to journalists at the end of proceedings, the plaintiff claimed that she had passed through physiological and emotional trauma as well as mental stress as a result of what she called a failed relationship and passionately appealed to the court to dissolve the marriage, which she insisted had become toxic.
