N432 fraud: Court adjourns El-Rufai’s case against Kaduna Assembly till July 17

Guardian Nigeria 2024/10/6

The Federal High Court sitting in Kaduna State on Monday adjourned hearing in the case filed by the former Governor of the state, Nasir El-Rufai, challenging the State House of Assembly and the Attorney General of the State over the report of alleged N432 fraud against him and his ex-aides to July 17.

At the commencement of the hearing of the case, the counsel to the first respondent, the Kaduna State House of Assembly, Sani Katu (SAN), informed the court that they are in the process of filing a notice of preliminary objection, challenging the court’s jurisdiction to hear the case.

However, the counsel, therefore, requested an extension of time to enable them to file all their applications on the case filed against his client by the applicant, Nasir El-Rufai.

Also, the plea was advanced by the Commissioner of Justice and Attorney General of Kaduna State, Sule Shuaibu, SAN, who is a defendant in the case.

Besides, on his own part, the lawyer of the applicant, Sule Umoru, did not oppose the application for an extension of time.

After listening to all the submissions made by the counsels, the presiding judge, Justice R.M. AIKAWA, adjourned the case to July 17, 2024, to enable the respondents to file all their applications including the substantive application.

The ex-Governor, El-Rufai had on June 26, filed a case at the Federal High Court Kaduna to challenge the probe report of the Kaduna State House of Assembly which indicted him for corruption through alleged N432 fraud during his eight years of administration.

Meanwhile, among the claims El-Rufai asked the court, included that the Assembly report be declared null and void for violating his right to a fair hearing as guaranteed under the Constitution, and the violation of his fundamental human rights since he was not invited by the House to defend himself against N432 fraud allegations levelled against him.
