ASABA/Nigeria: In a scathing letter addressed to Elder Omeni Sobotie, Delta State Chairman of the All Progressives Congress (APC), legal luminary Michael E. Ukusare, Esq., of M. E. Ukusare & Associates, has raised alarm over what he deems a “major constitutional error” within the party.

The letter, dated May 4th, 2024, delves into the recent appointment of Olorogun O’tega Emerhor, CON, as the Chairman of a Reconciliation Committee purportedly formed during an ‘Expanded State Caucus’ meeting.

Ukusare, a bonafide member and legal counsel for the party, asserts that such a move is fundamentally flawed and calls for urgent rectification.

“Nobody builds anything on nothing and expects it to stand,”.

Ukusare stated, emphasizing the necessity for adherence to the party’s constitution. He highlights the absence of provisions for an ‘Expanded State Caucus,’ branding it an “ab initio nullity.”

The legal expert contends that Sobotie’s unilateral actions in convening and chairing the meeting violated the APC’s constitution, casting doubt on the legitimacy of Emerhor’s appointment.

Ukusare insists that any effort outside the party’s constitutional framework is inherently flawed and urges the State Executive Committee (SEC) to intervene promptly.

Central to Ukusare’s argument is the failure to adhere to Article 11, paragraph B(ii) of the APC Constitution, which outlines the composition of the State Caucus.

He asserts that the inclusion of members not recognized by the constitution undermines the party’s integrity and risks legal repercussions.

While expressing support for Emerhor’s peace-building endeavors, Ukusare emphasizes the paramount importance of upholding the rule of law within the party’s ranks.

He calls for immediate corrective measures to ensure the legitimacy and effectiveness of the reconciliation efforts.

In light of Ukusare’s compelling legal analysis, the Delta State APC finds itself at a crossroads, grappling with internal discord amid aspirations for post-election harmony.

As the party navigates these turbulent waters, the resolution of this constitutional impasse stands as a litmus test for its commitment to democratic principles and intra-party cohesion.

For Elder Omeni Sobotie and the State Executive Committee, the ball is now firmly in their court as they face mounting pressure to rectify what Ukusare describes as a “dead constitutional end.”
