Dan’adam Da Kudi?

A cikin sarkakiyar tsarin tattalin arzikin Nijeriya, akwai tsarin bayar da gudunmawar fansho (CPS), wanda ke nuni da kudurin kasar na tabbatar da kyakkyawar makoma ga ma’aikatan gwamnati da kuma masu zaman kansu wadanda suka yi ritaya.

A halin yanzu, wannan tafiya mai kyawun niyya na cike da kalubale, batun bin ka’ida, batun tsarin shari’a, kin bin ka’ida daga bangaren zartarwar Nijeriya da kuma kwanton bauna na ‘yan majalisar kasa.

Tsarin fansho na Nijeriya, ya samu gagarumin sauyi tare da kafa dokar sake fasalin fanshon (PRA) a shekarar 2004, daga baya kuma aka maye gurbinsa da PRA shekarar 2014. An haifo wannan fasali ne bisa larura, gazawa da kuma rashin iya magance dimbin matsalolin da ake fama da su, don maye gurbin tsare-tsaren fansho na ‘Defined Benefit Scheme’ (DBS), wanda ya dogara kacokan a kan kason kasafin kudin gwamnati.

Har ila yau, a karkashin tsarin bayar da gudunmawar fansho (CPS), ana bukatar dukkanin ma’aikatu da ma’aikatan gwamnati da masu zaman kansu, su bayar da gudunmawar adadin kason albashinsu; don fansho musamman a lokacin ritayarsu da kuma samar da ingantaccen tsarin fansho mai dorewa.

Bayan shekara ashirin da aiwatar da shi, CPS ta kawo ci gaban tattalin arzikin kasa; inda ta samar da gurbin rancen kudin fansho ga gwamnatin tarayya da rage yawan kudaden da ake warewa da kuma kashewa a bangaren gwamnati, ta hanyar inganta tanadin kudin cikin gida da samar da tarin makudan kudaden bashi mai dogon zango, domin ayyukan raya kasa da kara zuba jari daga kamfanoni masu zaman kansu a Nijeriya. A cewar PenCom, zuwa ranar 31 ga Maris, 2024, adadin akdarorin fansho ya kai Naira tiriliyan 19.7; wanda tsarin CPS ya tara tare da zuba jari, don bunkasa tattalin arzikin Nijeriya.

A cikin ‘yan shekarun nan, an samu cece-kuce, rudani da shige da fice tsakanin wasu nau’ikan ma’aikatan gwamnatin tarayya, don yin hijira da kuma ficewa daga CPS tare da komawa tsarin DBS. Batutuwan nasu dai sun kasance kan adadin kudaden ritayar da suka yi imani ba zai ishe su ba, lokacin da suka yi ritaya. (Abin mamaki, yadda wasu ‘yan Nijeriya su ka karkata kenan tare da nuna son kai!). Fitattun nau’o’in irin wadannan ma’aikatan gwamnatin tarayya, sun hada da Shugaban Ma’aikatan Gwamnatin Tarayya (Head of the Cibil Serbice of the Federation) da Manyan Sakatarori (Permanent Secretaries).

Cikakken Albashi Har Bayan Rayuwa

A shekarar 2019, Shugaban Kasa Muhammadu Buhari; ya ba da umarnin tumbuke Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori daga karkashin tsarin bayar da gudunmawar fansho (CPS) tare kuma da ba su damar samun cikakken albashi na rayuwa. Kafin kiftawar ido, umarni daga Ma’aikatar Kudi, Kasafin Kudi da Tsare-tsare na Kasa; ya bayar da umarnin mayar da ‘yan fansho na Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori da suka yi ritaya Ofishin Shugaban Ma’aikata na Tarayya da kuma ba da umarnin biyan cikakken albashi a matsayin fansho ta hanyar ‘Integrated Payroll and Personnel Information System’ (IPPIS). A lura fa! Wannan tsari na ‘IPPIS’, an tsara shi ne don ma’aikata masu aiki, ba masu ritaya ba.

Ra’ayin Sharholiya Na Babban Lauyan Tarayya

Hijira da kuma kebancewar Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori na Tarayya daga tsarin bayar da gudunmawar fansho (CPS), ya dogara ne a kan gurbatatcen ra’ayin da ba na shari’a ba na Babban Lauyan Tarayya a lokacin (Ministan Shariá). Wannan ra’ayi ya bayyana cewa, wadannan jami’ai ba ma’aikata ba ne a karkashin dokar sake fasalin fansho (PRA – 2014), amma ma’aikata ne na shugaban kasa; kamar yadda sashe na 171 na kundin tsarin mulkin tarayyar Nijeriya na shekarar 1999 (kamar yadda aka yi wa kwaskwarima). Sakamakon haka, a cikin Afrilun 2019, Shugaba Buhari ya amince da tunbuke su daga tsarin bayar da gudunmawar fanshon (CPS), tare da sanya su karkashin tsarin “Albashi na har bayan rayuwa”.

Tambayoyi:

a- Shin yaushe ra’ayi ya zama doka?

b- Shin tsarin IPPIS na nufin albashi da alawus na tsawon lokacin aiki ne ko kuwa har da albashi har karshen wa’adin rayuwa?

Turbobin Gudanar Da Tsarin CPS

Bari mu kalubalanci wancan fassara ta Babban Lauya na rashin kan gado da dalilan da suka hada da:

1- Sashe na 171 na Kundin Tsarin Mulkin 1999 da ya shafi nada wasu jami’an gwamnati, wanda Shugaban Kasa ya yi; ba ya magance batun fansho ba ne. Don haka, fasararsa cin zarafin kundin tsarin mulki ne.

2- Sashe na 173(1) na Kundin Tsarin Mulkin 1999, ya ba da umarnin cewa; duk wani abu da ya shafi fansho zai zama doka ne ta hanyar Majalisar Dokoki ta Kasa.

3. Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori, hakika ma’aikatan gwamnati ne, sannan kuma suna nan kamar yadda shugaban kasa ya nada su, kamar yadda sashe na 171 (3) da (6) na Kundin Tsarin Mulki ya bayyana a fili. Saboda haka, kebe su daga dokar PRA ta 2014, ya bar su ba tare da wata doka da ke tafiyar da fanshonsu ba kenan.

4- Dokar sake fasalin fansho ta (PRA) 2014, ita ce babbar dokar tarayya da ke tafiyar da al’amuran fansho a Nijeriya. An samar da karin wasu dokoki, don daidaita kudaden fansho na Hukumomin Soja da Tsaro. Har ila yau, an kafa dokoki guda biyu (2) don daidaita kudaden fansho na Jami’an Shari’a bisa ga sashe na 291 na Kundin Tsarin Mulki na 1999, kamar yadda aka gyara.

5- Sashe na 6 da 7 na PRA 2014, sun yi shelar cewa “Masu rike da makaman siyasa, kamar Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori, tsarin Fansho na bayar da gudunmawa (CPS) ne da ke kula da su, amma za su yi ritaya da kashi 100 na albashinsu a matsayin fansho, ta yadda idan asusun Fanshon nasu (RSAs) ba zai iya samar da wannan fansho ba, gwamnatin tarayya za ta ba da cikon kudin gibin ta hanyar kasafin kudin shekara-shekara.

6- Kotun koli ta yanke hukunci a shari’ar Saraki da Gwamnatin Taryya (SARAKI Bs. FGN) (a cikin 2016) LPELR-SC.852/2015 cewa, babu wata da’ira ko wasu kayan aikin gudanarwa ko wasu baragurbin dalilai da za su iya maye gurbin Kundin Tsarin Mulki ko Dokokin da Majalisar Dokoki ta Kasa ta kafa.

7- Dokar sake fasalin fansho ta 2014, ta bai wa Hukumar PenCom iko na musamman kan gudanar da fansho. Tabbas, Shugaban Ma’aikatan Gwamnatin Tarayya da Manyan Sakatarori, ta hanyar sa’a da samun kansu a cikin manyan mukamai, sun nemi samun kebancewa tare da cin abinci daga gumin Nijeriya. A matsayinsu na manyan da ke da alhakin aiwatar da manufofin Gwamnatin Tarayya, sun nuna rashin gaskiya da ladabi da rashin da’a, wanda tsarin mulki ya bukata daga gare su, inda kuma suka yi mata karan-tsaye.

Sakamakon Wauta

a- Tasirin Wannan Wauta- Kebe wadannan manyan jami’ai daga karkashin tsarin bayar da gudunmawar fansho (CPS) tare da sanya su a kan Albashin Rayuwa, zai haifar da babban nauyi na kudi da kuma yiwuwar kawo cikas ga manufofin kasafin kudi na gwamnatin tarayya da kwanciyar hankali na tattalin arziki da tsarin kudin Nijeriya.

Albashin wata-wata na Manyan Sakatarori (Perm.Secs) ya kai Naira 898,000, kuma hakkokinsu bayan yin ritaya, zai iya wuce Naira miliyan daya a kowane wata. Wannan tsari ba wai kawai zai kawo cikas ga kudaden gwamnati ba ne, har ma ya kafa misali mai hatsarin gaske; wanda zai haifar da irin wannan bukata daga sauran ma’aikatan gwamnati, wanda zai kara ta’azzara kalubalen kasafin kudi.

A cikin kasafin kudin shekarar 2023, Gwamnatin Tarayya ta ware Naira biliyan 854.81 ga Fansho da Giratuti da Fa’idodin Ritaya. Wannan adadi zai ci gaba da girma.

Kasafin kudin shekara-shekara na wannan kungiya ta ’yan Nijeriya marasa kishin kasa, abu ne mai ban tsoro, kuma kar ku manta suna karbar cikakken albashi yayin da suke kan kujerunsu na gata.

b- Rashin da’a da bin doka– Wannan halayya na nuna rashin da’a da kuma kin bin doka na manyan ma’aikata?

c- Maimaincin Karan Tsaye – Majalisar Dokoki ta Kasa ta zartar da wani kudirin doka da ya tunbuko ma’aikatanta daga karkashin tsarin bayar da gudunmawar fansho (CPS). Waiwayen wannan bangare yanzu ya zama wajibi.

d- Mutunci Da Kuma Dattako- Ga alama wasu ‘yan Nijeriya sun rasa shi.

Yana da muhimmanci don tabbatar da cewa, tsarin fansho ya kasance mai dorewa da adalci ga duk mambobin ma’aikatan gwamnati, domin kiyaye amana.

e- Tasiri – Wannan Kebewar na nuni da cewa, akwai banbancin launin fata tsakanin ma’aikatan gwamnati.

f. Kebewar na barazana ga mutunci da dorewar tsarin bayar da gudunmawar fansho (CPS), tare da lalata ka’idar daidaito.

Babu Locus Standi!

A- Wadannan rukunin mutane sun kare da yiwuwar bude hanyar ambaliya, don wasu su bi sahu sabili da ba su da gurbin tilasta wa wasu su ci gaba da zama a cikin tsarin bayar da gudunmawar fansho (CPS) kamar yadda su kansu ba su da imani ga manufofinta.

B- Hukuncin karya ka’idojin da’a ga jami’an gwamnati a Nijeriya, ya hada da ladabtarwa, kora, har ma da gurfanar da masu laifi. Jami’an gwamnati da aka samu da laifin yin amfani da mukamansu, don samun damar da ba ta dace ba ko gata; za su fuskanci sakamakon shari’a kamar tara, dauri ko kuma duka biyun. Yana da muhimmanci jami’an gwamnati su bi ka’idodin dabi’a, su kuma guji duk wani aiki da zai lalata amincin jama’a da amincewar gwamnati.

Sashi na 1 na Jadawali na Biyar na Kundin Tsarin Mulkin Nijeriya na 1999, musamman a sakin layi na 18 ya ce: “Duk wani zargin cewa, jami’in gwamnati ya saba ko kuma bai bi ka’idojin wannan dokar ba, za a gabatar da shi ga Ofishin Da’ar Ma’aikata (Code of Conduct).
