Anas faces second defeat in the 2-acre land case, charge 30,000 cedis damages

The Court of Appeal upheld the High Court’s decision on July 4, 2024, declaring Adolph Tetteh Adjei the rightful owner of a 2-acre parcel of land in Tse Addo. The judgment was delivered by a 2:1 majority, marking Anas Aremeyaw Anas’ second defeat in this case.

Case Summary:

Adolph Tetteh Adjei, the plaintiff, initiated the land action against Anas Aremeyaw Anas in 2017. Adjei claimed he had rightfully acquired the land from grantors whose interests traced back to the East Dadekotopon Development Trust (EDDT). Anas refuted this, stating his grantors were the Ataa Tawiah Tsinaiatse family.

During the High Court stage, Justice Anokye Gyimah granted Anas’ application to dismiss the suit on estoppel grounds, but the Court of Appeal reversed this order. Anas applied to the Supreme Court to quash the Court of Appeal’s decision, but it was dismissed, and a review was later denied.

Adjei, now the judgment creditor, applied for an injunction against Anas, who had entered possession of the land. Although Justice Amo Yartey dismissed the injunction application, the Court of Appeal reversed this decision, enjoining Anas from developing the property.

Justice Yartey granted Anas’ application for dismissal on estoppel grounds, but the East Dadekotopon Trust contested this at the Supreme Court. The Supreme Court quashed the ruling, ordering the case to return to the High Court for normal proceedings.

Throughout the case, injunctions were sought, and rulings were made and contested. Ultimately, on May 4, 2023, Justice Kwame Gyamfi Osei of the Land Court ruled in favor of Adjei, finding Anas had trespassed on the land, awarding costs of 60,000 cedis against him, and restraining him from further development.
