Drama As Businessman Drags His Own Wife To Court, Sues Her And Police For Alleged Harassment

Listed as respondents in the suit are the Commissioner of Police , Lagos State Command; the Divisional Police Officer (DPO) Anthony Police Station; Superintendent of Police Istifanus Daniel (IPO) and Mrs Endurance Modupe Makolo as 1st to 4th Respondents respectively.

Following an alleged incessant intimidation and harassment meted on him by the police on the instigation of his estranged wife Mrs Endurance  Makolo, a Lagos businessman Paul Makolo has filed a fundamental right enforcement suit before the Ikeja division of the Lagos State High Court.

Listed as respondents in the suit are the Commissioner of Police , Lagos  State  Command;  the  Divisional  Police Officer (DPO) Anthony Police Station; Superintendent of Police Istifanus Daniel (IPO) and Mrs Endurance Modupe Makolo as 1st to 4th Respondents respectively.

Makolo in the suit, averred that on November 14, 2023, he was arrested by 3rd Respondent and detained at the office of the 2nd Respondent over the complaint of his estranged wife that he was having extra-marital affairs.

He further averred that it took the intervention of several of his friends and relatives before he was admitted to bail by the 2nd and 3rd Respondents.

The applicant avers that since he was admitted to bail, the 3rd Respondent has been harassing and intimidating him with calls and severally threatened that he has the instructions of the 2nd Respondent to re-arrest and further detain him to the satisfaction of his wife

He is seeking amongst other things, “A declaration that his arrest and detention by the 2nd and 3rd Respondents on the complaint of his wife is unlawful and unconstitutional.

“A declaration that the threats, arrests, harassment, intimidation and embarrassment of the applicant by the Respondents over a civil contract and matrimonial issues between the applicant and the 4th Respondent amounts to a violation of his fundamental right.

He is also seeking an order restraining the 1st to 3rd Respondents, their agents, privies or howsoever called from further intimidating, arresting, detaining or further detaining him.
