Rivers:'The Court Of Appeal Has Not Given Anybody Anything, It Only Defined 1 Thing' -Festus Ogwuche

A Nigerian Lawyer, Barrister Festus Ogwuche has clarified that the Court of Appeal has not granted any favors to the Pro Wike's Lawmakers and the Pro Fubara's lawmakers. He stated that the Court has merely delineated the jurisdictional boundaries of the High Court of Rivers State concerning the vacancy in the House of Assembly. 

He pointed out that the Supreme Court holds the ultimate responsibility for providing an interpretation that satisfies all parties involved. He argued that this final adjudication by the Supreme Court will offer a definitive understanding of the constitutional provisions. 

He said in an interview with Arise TV, ''I believe that the parties cannot give their own interpretation to Judicial decisions. The Court of Appeal has not given anybody anything, it only defined one thing. And that is the limits of the exercises of jurisdiction of the High Court of Rivers State with regards to the vacancy of the membership of the House of Assembly. 

The National Assembly also has the power to determine that vacancy by virtue of the constitution whether it panders with the constitution and the Federal framework is a different matter altogether. It's for the Supreme Court to give an interpretation that will satisfy all parties.''
