The suit instituted to restrain the Publicity Secretary of the Peoples Democratic Party, PDP, in Benue State, Chief Bemgba Iortyom, has suffered a set back as the matter had been adjourned to October 10th, 2024.

Mr Terese Achir had filed a motion, seeking to restrain Chief Iortyom from parading self as the State Publicity Secretary of the PDP in Benue State.

Mr Achir's suit was predicted on a puproted suspension of Chief Iortyom by some members of the PDP in Mbagba Council Ward of Ushongo Local Government Area.

When the matter came up on June 20th, 2024, Counsel to Mr Achir, C.N Agugu informed the court that ordinarily, the matter was fixed for hearing.

However, they were only able to serve the defendant the previous day and the defendant was still within time to file his response as he is entitled to fair hearing.

The Legal Adviser of the PDP in Benue State, Clement Mue who appeared for Chief Iortyom confirmed the submission of Agugu on the issue of service.

He told the court that he intends to vehemently oppose the motion and will be asking the court for another date to enable him file his processes.

After listening to both counsels, the Presiding Judge, Justice John Shishi adjourned the matter to July 11th, 2024, for hearing of the motion seeking to restrain the Benue PDP Publicity Secretary.

On the next adjourned(July 11,2024), the matter could not go on as the court didn't sit.

Counsels in the matter were advised to pick a new date for hearing of the motion.

October 10th, 2024, was eventually picked for hearing.

Interestingly, the tenure of Bemgba Iortyom as Benue State Publicity Secretary of the PDP, which the suit is seeking to restrain him from will elapse of August 31st, 2024.

It therefore means that as at the next adjourned date, the motion seeking to restrain Chief Bemgba Iortyom from parading as Publicity Secretary of the PDP must have become otiose and a mere academic exercise.
