APC Dispute Escalates: Kano High Court Steps In to Prevent Arrests

According to a report by Sahara reporters on Friday, May 3, 2024, the Kano High Court has issued an ex parte order, effectively barring the Inspector General of Police (IGP), the Assistant Inspector General (AIG) of Zone 1 Kano, and the Commissioner of Police in Kano from taking any action against the All Progressives Congress (APC) ward officers at Ganduje Ward, Dawakin-Tofa local government area of Kano State.

This order includes restraining them from inviting, arresting, or harassing the ward officers.

The ward executives had previously suspended Abdullahi Ganduje, the National Chairman of the APC, sparking controversy within the party.

The state working committee of the APC later overturned this suspension, leading to a legal dispute.

Reports indicate that security operatives initiated a manhunt to apprehend the ward officers following their suspension of Ganduje.

In response, Justice Yusuf Ubale Muhammad granted a consolidated order on May 2, 2024, preventing the APC National Working Committee, the state council of the party, and Ganduje himself from using security forces to arrest or detain the ward executives until the hearing and determination of the motion on notice.

The ex parte motion, filed by factional ward officers represented by their counsel, Shamsu Ubale Jibrin Esq, sought to protect their fundamental human rights as guaranteed by the constitution.

The court's decision was based on two affidavits, one sworn by Jafar Adamu (suit no. K/M759/2024) and the other by Haladu Gwanjo and Laminu Sani Barguma (suit no. K/M758/2024), challenging the actions of the IGP, AIG Zone 1 Kano, Commissioner of Police Kano, APC, APC NWC, Kano APC State Council, and Dr. Abdullahi Umar Ganduje.

The court's interim injunction prohibits the respondents from taking any action against the ward executives pending the determination of the motion on notice.

The respondents are ordered to be served with the interim order and all other relevant processes before the next adjourned date, set for June 5, 2024, when the motion on notice will be heard.
