Nzeakor explained, "The 1999 Constitution empowers the Federal High Court with the jurisdiction to determine if any seat of House of Assembly members are vacant." This statement sheds light on the ongoing legal proceedings concerning the status of certain legislative seats.

The matter of jurisdiction was recently addressed by a three-member judicial panel, which ruled to rest the issue of jurisdiction pending the determination of the substantive matter before the Federal High Court in Abuja. This decision explains the pivotal role of the Federal High Court in adjudicating disputes related to legislative vacancies.
