Senior Advocate of Nigeria (SAN) Oba Maduabuchi stated that the declarations of PDP defectors acknowledging their switch to the APC are legally binding and irreversible by judicial decree. Speaking to Arise News, Maduabuchi underscored that these defectors formally acknowledged their exit from the PDP and entry into the APC through sworn statements submitted in various courts.
He further asserted that their public statements and celebrations solidify their acknowledgment. As a legal expert, Maduabuchi emphasized that even if courts rule in favor of the defectors, any decision rendered without proper jurisdiction lacks enforceability. He stressed the paramount importance of upholding the law and safeguarding the Constitution.
Maduabuchi clarified, "While these PDP members may attempt to portray themselves as non-defectors, they cannot escape their own sworn affidavits submitted in multiple courts affirming their defection to the APC. Their enthusiastic chant of 'Your Mandate, We Stand' was clearly captured on video. As legal practitioners, we uphold the rule of law, so I fail to see any issue here. Jurisdiction is fundamental; without it, any court's decision lacks authority."
