Kogi Gov’ship: Court Of Appeal Takes Decisions On Ruling Date Of Ajaka’s Appeal

In a recent development, the Court of Appeal in Abuja has reserved judgment on an appeal by Muritala Ajaka, the Social Democratic Party’s (SDP) candidate, challenging the election of Governor Usman Ododo of Kogi State, as reported by Daily Trust.

The three-member panel of justices announced that judgment would be delivered on a later date after the adoption of all briefs filed in the matter.

Ajaka and the SDP are asking the appellate court to overturn an earlier judgement that upheld the victory of the All Progressives Congress (APC) and Governor Ododo in the November 11, 2023 election.

They want the court to declare them the winners instead.

Chief Kanu Agabi (SAN), counsel for the Independent National Electoral Commission (INEC), argued that the appeal by Ajaka and the SDP should be dismissed for lacking merit.

Joseph Daudu (SAN), counsel to Governor Ododo, claimed that the appellants failed to prove allegations of over-voting.

He argued that over-voting is not applicable under Section 137 of the Electoral Act, 2022.

Emmanuel Ukala (SAN), counsel to the APC, also urged the Court of Appeal to dismiss the appeal and described the appeal as incompetent.

The Court of Appeal's decision is awaited and will be communicated to the parties involved.
