Legal expert Fred Ezeakor clarified that the key issue concerning the status of lawmakers who switched from PDP to APC remains unsettled.

In an interview with Arise News, Ezeakor noted that the case is currently before Justice Okorowo in Abuja.

He added that the case is with the court and they're yet to decide whether these lawmakers are still considered members of the House of Assembly.

Ezeakor mentioned an affidavit sworn by Martin Amaewhule, which is publicly accessible and acknowledges their defection.

He highlighted that only the Federal High Court can issue a definitive judgment on whether their seats have been vacated due to their defection.

The recent decision by the Court of Appeal focused solely on jurisdictional matters and did not address the core issue.

In Fred Ezeakor's words in a video (7:05), he said, "The Substantive issue now has not been determined. Are these Gentlemen still members of the House of Assembly or not. That matter is still before Justice Okorowo in Abuja and it has not been decided and in Justice Okorowo's Court, there's an affidavit sworn by Martin Amaewhule which is in the public domain, an affidavit that they have decamped from PDP to APC."
