A Legal Practitioner and a legal Representative of the 381 delegates in Edo State, Barrister Andrew Enwanta has alleged that the Federal High Court had declared that the delegates who elected Asue Ighodalo in Edo PDP primary were not the right delegates.

He stated that consequently the court invalidated the documentation submitted to INEC, which was a significant aspect of the case. He explained that under INEC regulations, information from party congresses must be submitted and uploaded to the INEC portal for compliance verification during primaries. He identified that the court's decision invalidated the ad-hoc delegate results accepted by INEC, reinforcing the importance of strict adherence to regulatory procedures.

He said in an interview with AIT, ''This kind of judgement made by the Judge is what we call a mandatory injunction. And the implication is that you have done your primary but who were those who elected the candidate? It was one of the issue that came up for determination. The Court said that the people who elected him were not the people supposed to elect him and they invalidated the document that they presentee to INEC.

Because under the INEC regulation which we have studied, when you do your Congress, you submit that information to INEC then they upload it to their portal. So that if tommorow you are to do your primaries, it is what you upload on the INEC portal that will be used to see compliance. When we started this case, INEC made an undertaken that whatever final decision that will come, they will abide by that decision. And INEC was the first defendant in that case, they filed a memorandum of unconditional appearance. So whatever INEC has accepted as the Ad-hoc delegate result, the court has invalidated that by this decision.''
