The Nakuru High Court, presided by Lady Justice Patricia Gichohi, has upheld the lower court's conviction in a defilement case appealed by the appellant, name yet to be revealed.
The appellant is said to have been charged with defiling a 9-year-old girl on July 18th, 2018, in Rigogo area, Nakuru North sub-county, contrary to Section 8 (1) of the Sexual Offences Act, with an alternative count of committing an indecent act with the minor.
The appeal according to the reports given by the office of the director of Public prosecution was canvased by way of written submissions
The judge noted that during the trial, the prosecution had presented a compelling case against the appellant and found the appeal to have no merits before a ruling was made.
Originally, the suspect had been sentenced to life imprisonment, which was deemed unconstitutional, the judge imposed a 30-year jail term, considering the gruesome nature of the acts committed against the juvenile and the need for a deterrent sentence.
